New Tree Preservation Orders

This page lists Tree Preservation Orders (TPO) while the period for representations is open. We consider all representations before the Planning Committee confirms a Tree Preservation Order.

Legislation

Under the Town and Country Planning (Scotland) Act 1997 (as amended), Midlothian Council can make a Tree Preservation Order (TPO) on:

  • any individual tree
  • group of trees
  • or woodland area.

Before making a TPO, we must consider the preservation of the tree(s) to be "expedient in the interest of amenity", or that they are "of cultural or historical significance".
